§ 15.04.112. Confidential information.

(a)

Subject to Washington law, records maintained by the city with respect to the use, nature and frequency of discharges from any user shall be available to the public.

(b)

No correspondence claimed as "confidential" shall be withheld from any state or federal agency responsible for oversight of the city's NPDES permit or authority to implement the NPDES, or state or federal pretreatment programs. Wastewater constituents and characteristics, and other "effluent data" as defined by 40 CFR 2.302 will not be recognized as confidential information and will be available to the public without restriction.
