§ 12.20.210. Property owner reimbursement agreement—Optional.

  • A property owner required to comply with the provisions of this chapter, shall have the option of submitting a written request to the director of public works for the purpose of asking that the city undertake the required construction of the curbs, sidewalks and asphalt widening, or any combination thereof, at the expense of the property owner. If the director, upon receiving such a request, determines that it would be feasible for the city to undertake the required work, then the director shall prepare a property owner reimbursement agreement whereby the property owner will agree to reimburse the city for all actual engineering and construction costs incurred by the city in the course of performing the required work on behalf of the property owner. Execution of the property owner reimbursement agreement will require the consent of a majority of the council.
