§ 12.20.040. Curbs and sidewalks required.

  • Curbs and sidewalks shall be required to be permitted and constructed within city rights-of-way on city access and arterial streets where the same are not already in existence, or the same are in a state of disrepair as declared by the director of public works, on all sides or private property parcels adjacent to city access and arterial streets whenever any permit is used for new construction or for substantial improvement to a parcel, or any improvements resulting in a change of occupancy classification. Improvement resulting in a change in occupancy classification shall be deemed to have occurred if a manufactured home or mobile home siting permit is issued to locate a manufactured home or mobile home at any specific location, space or site, where a manufactured home or mobile home has not previously been lawfully located and existing at the effective date hereof, except in property zones R-l, R-1M, R-2, and R-3.

    Where curbs and sidewalks are otherwise required under this section no permit for construction, substantial improvement, or to site a manufactured home or mobile home shall issue except upon application of the owner, or an owner, of the real property where the permitted activity is to occur, and the property owner shall be responsible for compliance herewith.

    Curbs and sidewalks required to be constructed as provided by this chapter, shall be complete and accepted by the director of public works prior to occupancy, use, or change of use of the property permitted for new construction, substantial improvement, change of occupancy classification, or occupancy of a manufactured home or mobile home located at a specific location, space or site not previously occupied by a lawfully existing manufactured home or mobile home. Sidewalks hereby required shall extend the entire street front of the lot, parcel of land, or tract, upon which the new construction, substantial improvement or change of use is done, and shall attach to existing sidewalks on adjoining land. The city shall not provide water or electrical power to any structure or manufactured home or mobile home occupied in violation of the requirements of this section.
